  • §1 General Terms and Conditions By using or accessing RCSpot you agree to the following terms and conditions (“Statement”) 1. Privacy 1.1 Your privacy is very important to us. By registering on RCSpot you agree and acknowledge that RCSpot stores the information you provide in accordance with SFS 1998:204 Personal Data Act (sw. Personuppgiftslagen) .
  • §2 2. Safety We do our best to keep RCSpot safe but in order to do that successfully we need your help. You hereby agree to the following commitments regarding safety: 2.1 You will not send or otherwise post unauthorized commercial communications, such as spam. 2.2 You will not collect users' content or information, or otherwise access RCSpot using automated means (such as harvesting bots, robots, spiders, or scrapers) without our permission. 2.3 You will not upload viruses or other malicious code. 2.4 You will not solicit login information or access an account belonging to someone else. 2.5 You will not bully, intimidate, or harass any user. 2.6 You will not post content that is hateful, threatening, pornographic, or that contains nudity or graphic or gratuitous violence. 2.7 You will not use RCSpot to do anything unlawful, misleading, malicious, or discriminatory. 2.8 You will not do anything that could disable, overburden, or impair the proper working of RCSpot, such as a denial of service attack. 2.9 You will not facilitate or encourage any violations of this agreement.
  • §3 3. Registration and account security RCSpot users must provide their real names and real information. Here are some commitments you must make to us relating to registering and maintaining the security of your account: 3.1 You will not provide any false personal information on RCSpot, or create an account for anyone other than yourself without permission. 3.2 You will not use RCSpot if you are under 16. 3.3 You will keep your contact information accurate and up-to-date. 3.4 You will not share your password, let anyone else access your account, or do anything else that might jeopardize the security of your account. 3.5 You can not transfer your account to anyone else. 3.6 If you select a username for your account we reserve the right to remove or reclaim it if we believe appropriate (e.g when a trademark owner complains about a username that does not closely relate to a user's real name).
  • §4 4. Protecting Other People's Rights When using RCSpot we expect you to respect and protect other people’s rights. In order to do so, you commit to the following: 4.1 You will not post content or take any actions on RCSpot that infringes or violates someone else's rights or otherwise violates the law. 4.2 RCSpot can remove any content or information you post on RCSpot if we believe that it violates this Statement. 4.3 You will respect the copyright of others and will not post or otherwise use any copyright protected materials on RCSpot without consent from the copyright owner. 4.4 If you repeatedly infringe other people's intellectual property rights, we can and will disable your account, when appropriate. 4.5 You will not use RCSpot’s copyrights or trademarks or any other confusingly similar marks without our written permission. 4.6 If you collect information from users, you will obtain their consent, make it clear you (and not RCSpot) are the one collecting their information, and explain to the user what information you collect and how you will use it.
  • §5 5. Payment Terms When you make payments through RCSpot, you agree to these Payments Terms. 5.1. Making Purchases 5.1.1 When you confirm a transaction on RCSpot, you agree to be bound by and pay for that transaction. 5.1.2 Do not commit to a transaction unless you are ready to pay, because all sales are final. 5.1.3 If you purchase something that becomes unavailable before it can be provided to you due to technical errors, your only remedy is to receive a refund of your purchase price. 5.1.4 WE MAKE NO WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, WITH RESPECT TO ANY PRODUCTS OR SERVICES SOLD ON OR THROUGH RCSPOT. 5.2. Payment Sources 5.2.1 In order to make a purchase on RCSpot you need a PayPal-account. PayPal is an e-commerce business allowing safe payments and money transfers to be made through the Internet. 5.3. Purchasing and Using Credits 5.3.1 You may purchase credits from RCSpot to purchase virtual ads and events. 5.3.2 When you purchase or receive credits, you do not own the credits. Rather, you receive a limited right to use such credits in connection with certain features on RCSpot. 5.3.3 Purchases of credits are non-refundable. 5.3.4 You will not sell credits to anyone, or transfer them to anyone outside of RCSpot. 5.3.5 We may change the purchase price for credits at any time as well as the ways that you can use or transfer credits. We also reserve the right to stop issuing credits. 5.3.6 Credits are not redeemable for any sum of money or monetary value from RCSpot. 5.3.7 If you leave a balance of credits unused for three years, we may redeem those credits. 5.3.8 If you deactivate your account and do not reactivate it within 6 months, or if you delete your account, you will lose any accumulated credits. 5.3.9 If we deactivate your account and you do not meet any conditions necessary to reinstate it within 6 months, we may redeem those. 5.4 Actions RCSpot may take 5.4.1 As part of our effort to keep RCSpot safe, we may take certain actions to reduce liability for users and us. 5.4.2 We may make any inquiries that we consider necessary, either directly or through third parties, concerning your identity. 5.4.3 We may cancel any transaction if we believe the transaction violates these Payment Terms or the General terms and conditions, or we believe doing so may prevent financial loss. 5.4.4 We may cancel any credits transferred, assigned, or sold in violation of these Payments Terms or the General terms and conditions. 5.5. Disputes and Reversals 5.5.1 If you believe that an unauthorized or otherwise problematic transaction has taken place under your account, you agree to notify us immediately so that we may take appropriate action to prevent financial loss. 5.5.2 However, RCSpot does not take responsibility for any faults deriving from the services PayPal provides. 5.5.3 Your only remedy for a technical failure or interruption of service is to request that your transaction be completed at a later time. 5.5.4 To the fullest extent permitted by law, you waive all claims against RCSpot related to payments unless you submit the claim to us within 30 days after the charge. 5.5.5 If you enter into a transaction with a third party and have a dispute over the goods or services you purchased RCSpot have no liability for such goods or services. Our only involvement with regard to such transaction is as an advertisement space provider. 5.6. Special Provisions applicable to Advertisers 5.6.1 When you purchase advertising on or through RCSpot, you agree to pay all amounts specified in the order, along with any applicable taxes. 5.6.2 You are responsible for maintaining the security of your advertising account, and you understand that you will be charged for any orders placed on or through your advertising account. 5.6.3 You can cancel an advertising order at any time, but your ads may run for several days after you notify us, and you are still responsible for paying for those ads. 5.6.4 It is your responsibility to remit any taxes that apply to your transactions. You agree to indemnify and hold RCSpot harmless from and against any claim arising out of your failure to do so. 5.7. Notices and Amendments to these Payments Terms 5.7.1 We may provide notices to you by posting them on our website, or by sending them to an email address or street address that you have provided to us. Website and email notices shall be considered received by you within 24 hours of the time posted or sent; notices by mail shall be considered received within three business days of the time sent. 5.7.2 The Payment Terms in place at the time you confirm a transaction will govern that transaction. 5.7.3 We may change these Payment Terms, in whole or in part, even though the changes may affect accumulated credits. 5.8. Other 5.8.1 All of the commitments you make in the RCSpot’s General terms and conditions also apply to the payments made through RCSpot. In the event of any conflict between these Payments Terms and the RCSpot General terms and conditions, the Payments Terms shall prevail. 5.8.2 If you are under the age of 18, you may make payments only with the involvement of a parent or guardian. You should review these Payments Terms with a parent or guardian to make sure that you both understand them.
  • §6 6. Special provisions to the Market Place When you make an advertisement on RCSpot’s Market Place you agree to these special provisions: 6.1. Obligations 6.1.1 You are personally responsible for your advertisements. RCSpot is not under any circumstances responsible for the marketed products/services. 6. 1.2 If you enter into a transaction with a third party and have a dispute over the goods or services you purchased RCSpot have no liability for such goods or services. RCSpot’s only involvement with regard to such transaction is as an advertisement space provider. 6.2 Piracy and counterfeit You are prohibited to market any illegally duplicated and/or counterfeited products. 6.3. Illegal products Products that are prohibited according to Swedish law may not be marketed on RCSpot. 6.4. Offensive content Advertisements that may be offensive towards certain ethic groups, specific individuals or public persons are prohibited on RCSpot. 6.5. Unreal/fake offers RCSpot reserves the right to decide what constitutes an unreal or fake offer. Such offers can and will be removed from RCSpot.
  • §7 7. Amendments 7.1 RCSpot has the right to make changes and/or amendments to this Statement. You will be a given a notice when any changes and/or amendments has been made.
  • §8 8. Termination 8.1 You may terminate and delete your account or disable your application at any time. 8.2 If you violate any conditions or the spirit of this Statement, or otherwise create possible legal exposure for RCSpot, RCSpot have the right to stop providing all or part of RCSpot to you. In such case we will notify you by email.
  • §9 9. Disputes 9.1 Any claim, cause of action or dispute ("claim") under this agreement shall be resolved by the Stockholm District Court in Sweden (Sw. Stockholms tingsrätt). The laws of Sweden will govern this Statement, as well as any claim that might arise between you and RCSpot, without regard to conflict of law provisions. 9.2 If anyone brings a claim against RCSpot related to your actions, content or information on RCSpot, you will indemnify and hold RCSpot harmless from and against all damages, losses, and expenses of any kind (including reasonable legal fees and costs) related to such claim. PLEASE NOTE THAT YOU USE RCSPOT AT YOUR OWN RISK. WE ARE PROVIDING RCSPOT "AS IS" WITHOUT ANY EXPRESS OR IMPLIED WARRANTIES INCLUDING, BUT NOT LIMITED TO, IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT GUARANTEE THAT RCSPOT WILL BE SAFE OR SECURE. RCSPOT IS NOT RESPONSIBLE FOR THE ACTIONS, CONTENT, INFORMATION, OR DATA OF THIRD PARTIES, AND YOU RELEASE US, OUR DIRECTORS, OFFICERS, EMPLOYEES, AND AGENTS FROM ANY CLAIMS AND DAMAGES, KNOWN AND UNKNOWN, ARISING OUT OF OR IN ANY WAY CONNECTED WITH ANY CLAIM YOU HAVE AGAINST ANY SUCH THIRD PARTIES.
  • §10 10. Other 10.1 This Statement makes up the entire agreement between the parties regarding RCSpot, and supersedes any prior agreements. 10.2 If any portion of this Statement is found to be unenforceable, the remaining portion will remain in full force and effect. 10.3 If we fail to enforce any of this Statement, it will not be considered a waiver. 10.4 Any amendment to or waiver of this Statement must be made in writing and signed by us. 10.5 You can not transfer any of your rights or obligations under this Statement to anyone else without RCSpot’s consent. 10.6 All of RCSpot’s rights and obligations under this Statement are freely assignable by us in connection with a merger, acquisition, or sale of assets, or by operation of law or otherwise. 10.7 Nothing in this Statement shall prevent us from complying with the law. 10.8 This Statement does not confer any third party beneficiary rights.
